Indian – Mongolian Transfer Contract

The governments of Mongolia and India have decided to present a draft law project regarding the “Transfer of Convicted Citizens between Mongolia and India” to the Mongolian Parliament.

Over the past five years, five Mongolian citizens had been accused of being an accomplice to a crime; one of them was sentenced and duly served his term. Currently, no Mongolian is being sentenced in India.  Mongolia subsequently made an official offer to India to enter into a “Sentenced Persons Transfer Contract”, under which citizens of one country, convicted of a crime in the other country would be able to serve their term in prison, in their home country. This could improve the legal environment of the sentenced persons. India accepted the Mongolian offer.

In addition, in 1978, Mongolia joined the “Berlin Convention on the Transfer of Sentenced Persons”. Currently, Mongolia has concluded with Russia, China, Korea, Turkey, Poland, Canada, and Cuba.
