The prime minister’s economic advisor, B.Lkhagva, answered our correspondent’s questions about the new election law.


Q: Some people do not like some provisions of the new election law. MPs won’t criticize it because they passed it. What is your opinion on it?

A: People’s opinions on the law are their own private issue. If citizens complain to the Constitution Court, it will take time. Some other officials such as the president, prime minister, and speaker could complain to the Constitution Court. If one of them were to complain, the Constitution Court should promptly discuss the complaint.

Q: Would you complain to the Constitution Court?

A: In my opinion, parliamentary and local managing officials’ elections should be separately organized. But I was not able to submit the necessary amendments.

Q: Do you believe that the 2012 parliamentary election will be fairly organized by the new election law?

A: There are no perfect laws. Good laws depend on enforcement. If law enforcement is good, bad laws will became good laws. If a law is well prepared but not enforced fairly, that law will become a bad law.
If the new election law is fairly enforced, it may be a good law. If politicians interfere with it, the law may become a bad law.

Q: The law on election has strong accountability measures, people say. What is your opinion about it?

A: I raised accountability issues after the 2008 parliamentary election. The new law on election holds candidates, voters, and officials who organize the election accountable. But I do worry that it could violate the political rights of citizens. Mongolia is a democratic nation. There was a problem that the two major parties falsely reported their finances and expenditures during the 2008 parliamentary election. Their reports stated that an MP spent MNT 9 million on election advertisements. That amount could not have existed. Because I have spent about MNT 100 million when I have nominated myself. The issue is about the ethics of politicians.

Q: Some say the law makes an uneven playing field for candidates. What do you think about that?

A: It will be very difficult. The papers say that MPs embedded MNT 3 billion each for themselves in the state budget. New candidates face challenges running against them. There will be a short period of a time before the election, and candidates will not have time to introduce themselves to voters. The 2012 parliamentary election will be very difficult.

The election law should be passed right after Parliament forms. In this case, new nominates would have time to introduce themselves to voters. New candidates and small parties will not have a good chance in the 2012 election, in my opinion.
