The National New Party has filed an appeal with the Bayanzurkh district court seeking cancellation of the Oyutolgoi investment agreement between Ivanhoe Mines Mongolia Inc and the Mongolian Government. The party feels certain references in the agreement violate provisions in the Civil Law and the Mineral Law and damage Mongolian interests. For example, Ivanhoe Mines cannot be called ‘the investor’ as it has been allowed time to look for financial sources. It is thus, legally and financially, not an appropriate organization to sign an agreement.

Also Reference No.1.8 of the contract violates the 3rd reference of the 57th Parliament protocol made on July 16, of 2009. The party believes the agreement can be considered invalid also according to Civil Law ref. No.56. Based on Civil Law’s references No. 56.1.1, 56.1.2, 56.1.8, 56.1.10, 56.4, 56.5, 56.6 and No.57.1 and 57.2, the National New Party demands cancellation of the investment contract.
