Yesterday, the Constitutional Court had a meeting about some Governmental issues. According to their report, one of their discussions was connected to the law presentation to dismiss the Director of the Governmental Executive Authority S.Bayartsogt by the Member of the Parliament O.Baasankhuu. Whilst it is true that MP’s have the right to make draft law and make presentations to the Parliament – under Provision 37.2 of Constitution only; “The Mongolian Prime Minister has the right to make proposals about structural changes of the Government and only after discussion with the President”. Therefore, the Constitutional Court considers that – “Discussion about the dismissal of a member of the Government by the Parliament contravenes the Mongolian Constitution, since a Member of Parliament presented the project to Speaker and not to the Prime Minister”.
