Prosecutor General again demands dismissal of Ch.Sangaragchaa

Prosecutor General D.Dorligjav has written for the third time demanding the
dismissal of the director of the Anti-Corruption Authority (ACA),
Ch.Sangaragchaa. Another development that has been revealed is that the case of
MP L.Gundalai is going to be closed, after it had been reopened at the time
when the Standing Committee on Justice discussed Sangaragchaa’s case. Observers
see the hand of Sangaragchaa behind the reactivation of the case relating to Gundalai,
in the same manner as happened when the head of the Inspection Department at ACA,
E.Amarbat, then investigating the Gundalai case, was charged with raping a
woman. The woman was believed to be the lawyer of Gundalai and former MP S.Otgonbayar.
Covering one case with another is becoming a fashion in Mongolia.

answered reporters’ questions on the issue of the ACA head.

Did the Standing
Committee on Justice decide against dismissing Ch.Sangaragchaa because it has
16 members from MPRP?

Article
.22 of the Anti-Corruption Law states that the Prosecutor General will submit a
proposal to Parliament to dismiss officials of Anti-Corruption Authority if he
finds they are guilty of violating the law. Parliament must act on his request
within 14 days. In the present issue the Standing Committee decided there was
no reason to dismiss him now and wanted further investigation. Sangaragchaa
also said he wanted more investigation. However, the investigation can begin
only after he has been suspended from his position by Parliament, because as
director of ACA, he is protected by law. There should not be any politics where
the ACA head is involved. Everyone is equal before the law and ACA officials should
be subject to investigation as anybody else.

The Standing Committee
again talked about Gundalai’s case, while Sangaragchaa has said the prosecutor’s
office is putting pressure to close this case.

ACA
has no power to close a case, so where is the question of putting pressure on
it to do something beyond its authority? Only prosecutors can close a case. All
these rumors are being spread to distract attention, politicize the issue and waste
time.

Who profits now that
Parliament has gone on recess without settling the case?

This
gives more time to those facing the charges. They have already managed to erase
information on the hard discs of their computers, and would use the respite
gained to destroy more evidence.

Is it true that listening
devices were placed in the rooms of 22 MPs, who are now being blackmailed?

I
cannot comment on this. I can only say that if the ACA authorities spent public
money unjustly, they will have to explain their acts. If they are found to hve
broken the law, they will face punishment.
