The decree states:
“Based on Part 8 of Provision 1 of Article 33 of the Constitution of Mongolia, Provision 2 of Article 15 of the Law on President of Mongolia and Provision 77.2 of Article 77 of the Criminal Code of Mongolia, I decree:
To pardon Nambaryn Enkhbayar, a convict serving a sentence at the Detention Center 401 under the Court Decision Enforcement Agency, and release from the remaining term of the sentence.
Signature Tsakhiagiin Elbegdorj ”
Enkhbayar was sentenced in August 2012 after his arrest in April on charges of corruption and the illegal privatization of a state owned hotel. A reason for the release has yet to be announced but speculation is that it is because of Enkhbayar”s poor health. Enkhbayar spent less than one month in prison and spent most of his prison term as a patient at the Second General Hospital where high ranking government officials are medically treated. Throughout this time Enkhbayar has remained the head of MPRP and has maintained his innocence.
Yesterday Enkhbayar was release from completing the rest of his jail term, effective from the date of the decree.
