
During the trial the Supreme Court re-examined the case to confirm if the sentence for him was reasonable. N.Enkhbayar was sentenced to four years in jail. The Supreme Court re-affirmed N.Enkhbayar’s abuse of power and involvement in illegal privatization of Urguu hotel and Ulaanbaatar times publishing house which were the property of the City. Using his influence he defrauded it to his Escon LLC during his term as president. But the Supreme Court ignored the case against N.Enkhbayar involving fraudulent TV equipment donated from aJapanese religious organization, Agonshu, to Mongolian Buddhist organization where a loss to State owned Erdenet LLC was caused by grouping with J.Myagmarjargal under the Law of Criminal Procedure 248. 1.2 article because there was not enough evidences.
The Supreme Court judges reduced the jail term sentence for N.Enkhbayar to 2.6 years and for J.Myagmarjargal to one year due to the lack of evidence in some cases against them. The Court also re-affirmed the mercy to Do.Chuluunbaatar, D.Dulamsuren`s two years jail term.
The Supreme Court also ignored the decision to seize 119.534.302 illegal income by the television station TV 9 by appeal court according to the Law of Criminal Procedure 49.2 article.
At the beginning of the trial N.Enkhbayar`s attorneys B.Oyunbileg and O.Saingerel proposed their refusal to the panel of five judges of the Chamber of Criminal Cases in the Supreme court, because they claimed the judges were working with politically influenced interests and requested to postpone the trial. But the judges of the Chamber of Criminal Cases refused their proposals. As a result B.Oyungerel and O.Saingerel left the trial opposing the judges` answer. While the trial was held supporters of MPRP demonstrated outside of the Supreme Court building in a peaceful manner holding slogans stating “Respect the law”,” N.Enkhbayar is a son of the people”, and “The trial is illegal”
